{"id":3192,"date":"2021-07-14T18:57:27","date_gmt":"2021-07-14T18:57:27","guid":{"rendered":"https:\/\/www.loveloparks.org\/?page_id=3192"},"modified":"2021-11-06T21:36:28","modified_gmt":"2021-11-06T21:36:28","slug":"measure-3-568","status":"publish","type":"page","link":"https:\/\/www.loveloparks.org\/index.php\/causes\/protect-our-natural-parks\/measure-3-568\/","title":{"rendered":"Measure 3-568"},"content":{"rendered":"\n<p style=\"text-align:center\" class=\"has-text-color has-vivid-red-color wp-block-paragraph\"><strong><a href=\"\/index.php\/2021\/11\/02\/citizen-initiated-measure-3-568-passes\/\">Update Nov 2, 2021: Lake Oswego voters approve Measure 3-568!<\/a><\/strong><\/p>\n\n\n\n\n\n<figure class=\"wp-block-image\"><img loading=\"lazy\" decoding=\"async\" width=\"2850\" height=\"1950\" src=\"https:\/\/www.loveloparks.org\/wp-content\/uploads\/2021\/10\/Postcard-6x9.jpg\" alt=\"\" class=\"wp-image-4067\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Lake Oswego citizens began circulating citizen initiative petition <strong><a href=\"\/index.php\/causes\/protect-our-natural-parks\/2020in-1\/\">2020IN-1<\/a><\/strong> in<strong> <\/strong><a rel=\"noreferrer noopener\" href=\"\/index.php\/2019\/12\/12\/citizen-initiative-petition-2020in-1-receives-approval-to-circulate\/\" target=\"_blank\">December 2019<\/a>. For 18-months, hundreds of residents volunteered thousands of hours and donated $28,000+ to reach, inform, and educate the Lake Oswego community about the legal protections we seek for these natural areas. <strong><a href=\"\/index.php\/causes\/protect-our-natural-parks\/2020in-1\/\">2020IN-1<\/a><\/strong> needed signatures from 15% of Lake Oswego&#8217;s registered voters, or 4,365 signatures, to qualify for the ballot; we collected over 4,800 signatures and qualified with 4,433 verified signatures on June 23, 2021, resulting in Citizens&#8217; <strong>Measure 3-568<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Measure 3-568<\/strong> <a rel=\"noreferrer noopener\" aria-label=\"amends the Lake Oswego City Charter\u2019s Chapter X - Park Development Limitation (opens in a new tab)\" href=\"\/index.php\/causes\/protect-our-natural-parks\/charter-amendment\/ \" target=\"_blank\">amends the City of Lake Oswego&#8217;s Charter Chapter X &#8211; Park Development Limitation<\/a> to protect Springbrook Park and 15 additional natural parks with sensible development limitations to keep these natural parks safe, accessible, healthy, and vibrant natural habitats. <strong>Measure 3-568<\/strong> was <a href=\"https:\/\/www.loveloparks.org\/index.php\/causes\/protect-our-natural-parks\/endorsed\/\">endorsed<\/a> by two prominent environment and conservation organizations, <strong><a rel=\"noreferrer noopener\" aria-label=\"Oregon Wild (opens in a new tab)\" href=\"\/index.php\/2021\/08\/24\/oregon-wild-endorses-measure-3-568\/\" target=\"_blank\">Oregon Wild<\/a><\/strong> and <strong><a rel=\"noreferrer noopener\" aria-label=\"Sierra Club (opens in a new tab)\" href=\"\/index.php\/2021\/09\/04\/sierra-clubs-oregon-chapter-endorses-measure-3-568\/\" target=\"_blank\">Sierra Club<\/a><\/strong>, on August 24th and Sept 4th, respectively, after carefully vetting the Citizens&#8217; <strong>Measure 3-568<\/strong> and City Council&#8217;s referred Measure 3-575.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Citizens are pursuing strong legal charter protections due to frustrations with repeated City attempts to develop and\/or encroach upon one or more of our natural parks (Springbrook Park, Bryant Woods, Woodmont Park, Cooks Butte, amongst others) and a tedious public process that minimizes citizens involvement and voice. One recent example: Cooks Butte was deeded to the City in 1975 by the Emery family for the purposes of remaining a natural habitat. The City has pursued development a top Cooks Butte 3 times (1994, 2002, and 2019) for a <a rel=\"noreferrer noopener\" aria-label=\"major telecommunications facility (opens in a new tab)\" href=\"\/index.php\/causes\/save-cooks-butte\/\" target=\"_blank\">major telecommunications facility<\/a>. Citizens strongly opposed each attempt and with the Emery family\u2019s assistance, development was prevented and this natural habitat untouched (for now).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current <a rel=\"noreferrer noopener\" aria-label=\"Chapter X - Park Development Limitation (opens in a new tab)\" href=\"https:\/\/www.codepublishing.com\/OR\/LakeOswego\/?LakeOswegoCH\/LakeOswegoCH10.html\" target=\"_blank\">Chapter X &#8211; Park Development Limitation<\/a> was placed on the ballot by citizen initiative and ratified in 1978 to \u201cpreserve Springbrook Park as a natural area\u201d and prevent the City from developing it into high-density housing and a <a rel=\"noreferrer noopener\" aria-label=\"major athletic facility (opens in a new tab)\" href=\"\/wp-content\/uploads\/2021\/07\/1978-Springbrook_Park-Athletic_Facility.pdf\" target=\"_blank\">major athletic facility<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chapter X, which currently only applies to Springbrook Park:<\/p>\n\n\n\n<ul style=\"padding-left: 20px\"><li style=\"padding: 10px\">Prohibits athletic facilities, parking lots, and roads or trails for motorized vehicles.<\/li><li style=\"padding: 10px\">Allows trails for hiking, jogging, horseback, and bicycle riding.<\/li><li style=\"padding: 10px\">Allows picnic and sanitary facilities.<\/li><li style=\"padding: 10px\">Allows for restrictions to apply to any park property acquired by bond and designated by voters as subject to these restrictions.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">A <strong>YES<\/strong> vote on <strong>Measure 3-568<\/strong> would maintain (black text) and enhance (<span class=\"has-text-color has-vivid-cyan-blue-color\">blue text<\/span>) Chapter X\u2019s development limitations:<\/p>\n\n\n\n<ul style=\"padding-left: 10px\"><li style=\"padding: 10px;\">Designates these natural parks as \u201cNature  Preserves:\u201d <span class=\"has-text-color has-vivid-cyan-blue-color\">Bryant Woods Park<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Canal Acres<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Cooks Butte Park<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Cornell Natural Area<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Glenmorrie Greenway<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Hallinan Woods<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Iron Mountain Park<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Kerr Open Space<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Lamont Springs Natural Area<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> River Run<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> South Shore Natural Area,<\/span> Springbrook Park,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Stevens Homestead<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> Stevens Meadows<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> West Waluga Park<\/span>,<span class=\"has-text-color has-vivid-cyan-blue-color\"> and Woodmont Natural Park.<\/span><\/li><li style=\"padding: 10px;\">Prohibits athletic facilities, parking lots, and roads or trails for motorized vehicles.<\/li><li style=\"padding: 10px;\"><span class=\"has-text-color has-vivid-cyan-blue-color\">Prohibits telecommunications facilities, asphalt and concrete hard-surface trails, and above-ground facilities or structures that would impair or be inconsistent with natural conditions.<\/span><\/li><li style=\"padding: 10px;\"><span class=\"has-text-color has-vivid-cyan-blue-color\">Prohibits tree cutting for purposes of commercial logging.<\/span><\/li><li style=\"padding: 10px;\">Allows trails for hiking, jogging, horseback, and bicycle riding.<\/li><li style=\"padding: 10px;\">Allows picnic and sanitary facilities<\/li><li style=\"padding: 10px;\"><span class=\"has-text-color has-vivid-cyan-blue-color\">Allows benches, boardwalks, and interpretive displays.<\/span><\/li><li style=\"padding: 10px;\"><span class=\"has-text-color has-vivid-cyan-blue-color\">Allows maintenance for ecological restoration that provides safe and healthy natural areas that are accessible for public enjoyment, provides a healthy habitat for wildlife, eliminates invasive species, restores native species, and mitigates fire hazards.<\/span><\/li><li style=\"padding: 10px;\"><span class=\"has-text-color has-vivid-cyan-blue-color\">Allows maintenance of existing facilities, structures, parking lots, roads or trails for motorized vehicle if not altered in any manner that would further impair or be inconsistent with natural conditions.<\/span><\/li><li style=\"padding: 10px;\"><span class=\"has-text-color has-vivid-cyan-blue-color\">Allows implementation of pre-existing park-specific master plans adopted prior to November 3, 2021 that may specify development that would otherwise be restricted by this Chapter.<\/span><\/li><li style=\"padding: 10px;\">Allows for restrictions to apply to any park property acquired by bond and designated by voters as subject to these restrictions or <span class=\"has-text-color has-vivid-cyan-blue-color\">if designated as a \u201cNature Preserve\u201d by the conveying property owners, the City, or voters.<\/span><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Any new master plan for parks designated as \u201cNature Preserves\u201d must be consistent with the charter amendment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Citizens&#8217; <strong>Measure 3-568<\/strong> allows natural park trail construction using ADA compliant materials, such as tightly-packed decomposed granite (or other suitable material), and boardwalks that are more compatible in natural areas and used broadly in national, state, and city wilderness areas and natural parks across the country.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Citizens&#8217; <strong>Measure 3-568<\/strong> DOES NOT impose any additional taxes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After citizens filed this initiative with 4,433 qualifying signatures for the ballot, the Lake Oswego City Council referred competing Measure 3-575 to the ballot.&nbsp; While City Council\u2019s Measure3-575 lists many of the same parks for designation as \u201cNatural Areas\u201d within 60 days of ratification by ordinance, it would allow the City to partition those parks into \u201cNatural Areas\u201d and areas subject to development.&nbsp; The City Council\u2019s Measure 3-575 would also allow development of parking lots, roads, and other facilities or structures, including the removal of park trees for this development, through the City\u2019s public master planning process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For <strong>Measure 3-568<\/strong> to become law, <strong>Measure 3-568<\/strong> must receive a majority vote and more YES votes than Lake Oswego City Council\u2019s competing Measure 3-575. &nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>BALLOT TITLE<\/strong><br>Our Citizens&#8217; <strong>Measure 3-568<\/strong>&#8216;s ballot title will be:<\/p>\n\n\n\n<p style=\"padding-left: 20px\"><strong>CAPTION<\/strong>: Restricts improvements on certain Lake Oswego park properties<\/p>\n\n\n\n<p><p style=\"padding-left: 20px\"><strong>QUESTION<\/strong>: Should the Lake Oswego City Charter be amended to restrict improvements on certain city park properties?<\/p><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Measure 3-568<\/strong>&#8216;s ballot title was <a rel=\"noreferrer noopener\" aria-label=\"assigned by the City Attorney (opens in a new tab)\" href=\"https:\/\/www.loveloparks.org\/index.php\/2019\/12\/12\/citizen-initiative-petition-2020in-1-receives-approval-to-circulate\/\" target=\"_blank\">assigned by the City Attorney<\/a> when our citizens initiative petition <strong>2020IN-1<\/strong> was approved for circulation in December 2019 and cannot, unfortunately, be changed. We believe it was written intentionally to stall our petition signature collection efforts and to confuse Lake Oswego voters.
