{"id":6108,"date":"2024-03-07T17:00:00","date_gmt":"2024-03-07T17:00:00","guid":{"rendered":"https:\/\/www.loveloparks.org\/?p=6108"},"modified":"2024-03-08T17:12:59","modified_gmt":"2024-03-08T17:12:59","slug":"court-rules-chapter-x-is-a-land-use-regulation","status":"publish","type":"post","link":"https:\/\/www.loveloparks.org\/index.php\/2024\/03\/07\/court-rules-chapter-x-is-a-land-use-regulation\/","title":{"rendered":"Court Rules Chapter X is a Land Use Regulation"},"content":{"rendered":"\n<p class=\"has-text-align-right wp-block-paragraph\">FOR IMMEDIATE RELEASE<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>LAKE OSWEGO, Oregon &#8211; March 7, 2024<\/strong> &#8211; LoveLOParks issues the following statement regarding Clackamas County Circuit Court&#8217;s ruling in case <a href=\"\/index.php\/causes\/waluga-park-west\/circuit-court\/\" title=\"\">24CV03746<\/a> confirming Lake Oswego City Charter Chapter X&#8217;s provisions are land use regulations. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;The LoveLOParks Steering Committee is pleased by the Circuit Court&#8217;s well articulated legal opinion affirming Chapter X&#8217;s purpose and limitations are land use regulations under <a href=\"https:\/\/oregon.public.law\/statutes\/ors_197.015\" target=\"_blank\" rel=\"noopener\" title=\"\">ORS 197.015<\/a>(11), thereby overruling the opinion to the contrary by the Lake Oswego City Attorney&#8217;s office,&#8221; stated Scott Handley, Chief Petitioner for <a href=\"\/index.php\/causes\/protect-our-natural-parks\/2020in-1\/\" title=\"\">2020IN-1<\/a> and Campaign Manager for <a href=\"\/index.php\/causes\/protect-our-natural-parks\/measure-3-568\/\" title=\"\">Measure 3-568<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Circuit Court&#8217;s <a href=\"https:\/\/www.loveloparks.org\/court-rules-chapter-x-is-land-use\" target=\"_blank\" rel=\"noopener\" title=\"\">legal opinion<\/a> issued on Wednesday is a significant victory for Lake Oswego voters and our democratic principles. The court acknowledged voters&#8217; rights under Oregon&#8217;s Home Rule and Initiative provisions, Oregon Constitution, <a href=\"https:\/\/ballotpedia.org\/Article_XI,_Oregon_Constitution\" title=\"\">Article XI(2)<\/a> and <a href=\"https:\/\/ballotpedia.org\/Article_IV,_Oregon_Constitution\">Article IV(1)(5)<\/a>, to enact municipal laws enshrined in the city charter and that Chapter X&#8217;s provisions are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>entirely consistent with and furthers the objectives set forth in the Lake Oswego Comprehensive Plan, and<\/li>\n\n\n\n<li>the type of municipal laws falling within the definition of a land use regulation under ORS 197.015(11)<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The court&#8217;s opinion is consistent with Lake Oswego voters&#8217; intentions for placing citizen-initiated Measure 3-568 on the ballot and ratifying it in the <a href=\"\/index.php\/2021\/11\/02\/citizen-initiated-measure-3-568-passes\/\" target=\"_blank\" rel=\"noopener\" title=\"\">November 2, 2021 Special Election<\/a> with a 62% voter-approval; thus, amending the City Charter to protect Lake Oswego&#8217;s Nature Preserves from all development inconsistent with preserving them as natural habitats.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Case <a href=\"\/index.php\/causes\/waluga-park-west\/circuit-court\/\" title=\"\">24CV03746<\/a> is ongoing pending an evidentiary hearing (TBD) to be held by the circuit court to determine if the proposed action by New Look Development LLC violates a substantive provision of Chapter X, sections 41 and 43. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">LoveLOParks encourages the community to read the full court opinion:<\/p>\n\n\n\n<p class=\"has-text-align-center wp-block-paragraph\"> <a href=\"https:\/\/www.loveloparks.org\/court-rules-chapter-x-is-land-use\" target=\"_blank\" rel=\"noopener\" title=\"\">https:\/\/www.loveloparks.org\/court-rules-chapter-x-is-land-use<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;We are humbled to live in a community that cares deeply to protect our City&#8217;s natural environment and a place we all call home,&#8221; concluded Mr. Handley.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-css-opacity is-style-dots\"\/>\n\n\n\n<p class=\"wp-block-paragraph\"><br><a href=\"https:\/\/www.loveloparks.org\">LoveLOParks.org<\/a> is maintained by the Lake Oswego residents who initiated, architected and supported  the Chapter X &#8211; Park Development Limitation charter amendment.
